تشهد الساحة القضائية في مصر تصعيداً غير مسبوق في الطعون الدستورية ضد قانون الإيجار القديم رقم 164 لسنة 2025، في مؤشر واضح على عمق الأزمة الاجتماعية والقانونية التي فجّرها التشريع الجديد منذ صدوره، فمع قيد سادس دعوى دستورية أمام #المحكمة_الدستورية_العليا يتزايد الرهان الشعبي على القضاء باعتباره طوق النجاة الأخير لملايين الأسر المهددة بفقدان مساكنها، خاصة كبار السن الذين أمضوا أعمارهم داخل بيوت تحولت فجأة إلى مصدر قلق وجودي.
الدعوى الأحدث، المقيدة برقم 43 لسنة 47 قضائية “دستورية”، أقامها المستشار السابق يحيى وفا، وتميّزت بكونها أول طعن يطالب بعدم دستورية القانون كاملاً، وليس الاكتفاء بالطعن في مواد بعينها، ما يضفي عليها وزناً قانونياً خاصاً قد يفتح الباب أمام إعادة النظر في فلسفة القانون برمته.
