صادرة عن فضيلة الأستاذ الدكتور علي جمعة – مفتي الديار المصرية وقتها.

🕌 مضمون الفتوى:
🔸 عقود الإيجار القديم الممتدة لا تخالف أحكام الشريعة الإسلامية.
🔸 قالت دار الإفتاء نصًا:
> “يجوز شرعًا استمرار الانتفاع بالعين المؤجرة، ويجوز توريث عقد الإيجار؛ لأن عقد الإجارة في أصله من العقود اللازمة التي تنعقد وتلزم الطرفين مادام التراضي قائمًا بينهما، وما دام العقد لم يُشترط فيه خلاف ذلك.”
🔸 أكدت الفتوى أيضًا أن الأجرة مهما قلت قيمتها الحالية تبقى صحيحة شرعًا طالما رُضِي بها وقت التعاقد، ولا يجوز للمؤجر المطالبة برفع الأجرة إلا وفق الاتفاق أو ما يقرره ولي الأمر بما يحقق المصلحة العامة.
🔸 كما نصت الفتوى على أن:
> “أولو الأمر – السلطة التشريعية والتنفيذية – لهم الحق في تنظيم العلاقة الإيجارية بما يحقق المصلحة العامة ويدرأ المفاسد عن المجتمع، شريطة ألا يؤدي ذلك إلى ظلم أو إخلال بالأمن الاجتماعي.”

1. الإيجار القديم حلال شرعًا ولا يتعارض مع الشريعة.
2. امتداد عقد الإيجار القديم جائز شرعًا طالما لم يُشترط خلاف ذلك.
3. قيمة الإيجار المتفق عليها قديمًا ملزمة للطرفين ما لم تُعدّل بالقانون لصالح تحقيق مصالح الناس.
4. للمشرّع الحق في تغيير القوانين لتنظيم السوق بما يناسب المستجدات، بشرط ألا يخل ذلك بالمجتمع وأمنهم
